6. Intellectual Property Rights

You retain all ownership rights to the audio recordings and text you create using the Service ("Your Content"). By using the Service, you grant us a limited license to:

• Process your audio through our transcription systems (OpenAI Whisper)
• Store your transcribed notes in our database
• Provide the Service's features to you

This license ends when you delete your content or close your account.

6.2 Our Property

The Service, including its design, code, features, and branding, is owned by MindTranscript and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

7. Third-Party Services

The Service uses third-party providers:

• OpenAI: For audio transcription and text enhancement
• Vercel: For temporary audio file storage (auto-deleted after 10 minutes)
• Neon: For secure database storage

Your use of these third-party services through our platform is subject to their respective terms and policies. We are not responsible for the actions or policies of third-party service providers.

8. Disclaimers and Limitations of Liability

8.1 Service Accuracy

While we strive for accuracy, we do not guarantee that:

• Transcriptions will be 100% accurate
• Enhanced text will meet your expectations
• The Service will be uninterrupted or error-free
• All content will be preserved indefinitely

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR OTHER INTANGIBLE LOSSES.

9. Indemnification

You agree to indemnify, defend, and hold harmless MindTranscript and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit through the Service

10. Termination

10.1 By You

You may stop using the Service and delete your account at any time. Upon deletion:

• Your notes will be deleted from our database
• Your account information will be removed
• Backup data may persist for up to 30 days

10.2 By Us

We may suspend or terminate your access to the Service at any time, without prior notice, if you violate these Terms or engage in conduct we deem harmful to the Service or other users.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending you an email notification (for registered users)

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through arbitration in Bengaluru, Karnataka, India, in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English, and the decision of the arbitrator(s) shall be final and binding.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
